While an uneven curb seems to have been the main issue, headlines today are filled with mentions of wild turkeys and their role in the incident.

The 60-year-old woman claims that as she was running away from the wild, aggressive birds, she stumbled into the curb. It was at this moment that she stumbled and hit her shoulder on the pavement. This impact led to serious injuries that eventually required no less than four separate surgeries. Ultimately, she was forced to resign from her job as a result of these injuries – having lost the ability to lift objects with any degree of strength.

The real question is simple: Why were the turkeys allowed to roam unchecked across the hospital premises? Furthermore, why was a car allowed to park in a clear “no-parking” zone – forcing the woman into a narrow “choke point” alongside several aggressive turkeys? In their defense, the hospital claims that the plaintiff could have used two “clearly marked” pedestrian walkways instead.

How Dangerous Are Wild Turkeys? 

According to various wildlife experts, turkeys have the potential to become aggressive with humans – especially if they feel cornered. This is exactly what the aforementioned plaintiff experienced when she was forced into a narrow area alongside the turkeys by an unlawfully parked car.

Some say that in theory, a large group of turkeys could completely overwhelm a single person – potentially causing serious injuries in the process. It is clear that the turkeys on the campus posed at least some threat to the general public, and their presence was clear. Therefore, the hospital had a legal obligation to address the turkey-related threat – either by removing them or posting clear signage warning the general public of this danger.
